We would like to have a system where the government cannot lock you in a dungeon and throw away the key without any evidence. The presumption of innocence was created as a safeguard against that type of overreach. Nowadays, we are seeing the erosion of the right to trial. When people are pressured to take guilty pleas, evidence is never actually heard. Witnesses may not be cross-examined. You’re just taking the plea because it’s the only way out of the bail trap.
